Terms of Service

Draft — pending legal review. This text is a working draft written to describe the intended model (a promotional placement, not a game of chance). It must be reviewed by a qualified lawyer before takethecrown.live processes real payments, in particular for EU / Spanish consumer law (right of withdrawal and its exception), VAT/tax treatment, and whether buyers act as consumers or traders.

Version 1.0. The version you accept at checkout is stored with your reign.

1. What takethecrown.live is

takethecrown.live sells a promotional placement: the right to have one track be the song that plays for visitors to a channel until another person pays the then-current price to take that placement. It is an advertising / promotion service.

takethecrown.live is not a lottery, sweepstake, contest, auction with bidding fees, or game of chance or skill. There is no prize, no jackpot, and no payment of any kind is made to a user at any point, including when they are outbid. The "longest reign" scoreboard and the Hall of Fame are informational rankings only and carry no monetary or material reward.

5. No refunds; immediate performance

The placement is delivered immediately upon payment: your track goes on air at once and begins accruing plays and clicks. Because the service is fully performed at that moment, all sales are final and non-refundable, except for the automatic refund described in section 4.

Where you are a consumer with a statutory right of withdrawal (for example under EU Directive 2011/83/EU or Spanish Royal Legislative Decree 1/2007), by completing checkout you expressly request that performance begins immediately and you acknowledge that you thereby lose your right of withdrawal once the service has been fully performed. You confirm this with a dedicated checkbox before payment.

takethecrown.live may remove any track from the queue or the crown at any time, without notice and without a refund, if it believes in good faith that the track breaches these terms or creates legal or reputational risk. A removed paid placement ends the reign; plays and clicks accrued up to that point are kept in your receipt.

8. Rights complaints / takedown

If you believe a track on takethecrown.live infringes your rights, email legal@takethecrown.live with: your contact details, identification of the work, the URL on takethecrown.live, a statement that you hold the rights or act for the rights holder, and a statement that the information is accurate. We will review and, where appropriate, remove the track promptly. We may forward your complaint to the person who submitted the track.

9. Plays, clicks and figures

A "play" is counted when a visitor unmutes / starts the embedded player, deduplicated to one per browser session per reign. A "click" is counted when a visitor follows the outbound link to the track, deduplicated the same way. These figures are best-effort estimates provided for your information. takethecrown.live does not guarantee any level of traffic, plays, clicks, streams, followers, revenue or any other outcome, and the "cost per play" shown on a receipt is a descriptive statistic, not a promise.

10. Acceptable use

Do not attempt to inflate plays or clicks, automate purchases, probe or disrupt the service, or use it to launder money. Breach may result in removal without refund and a ban.

11. Liability

The service is provided "as is". To the maximum extent permitted by law, takethecrown.live is not liable for indirect or consequential loss, or for loss of profits, goodwill or expected exposure. Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Subject to that, takethecrown.live's total liability to you for any claim is limited to the amount you paid to takethecrown.live in the 3 months before the claim.

12. Indemnity

You will indemnify takethecrown.live against claims, losses and reasonable costs arising from a track you submitted or from your breach of these terms, including intellectual-property claims by third parties.

13. Changes

We may update these terms. The version in force when you pay is the one that governs that reign, and is recorded against it.

14. Governing law

These terms are governed by the laws of Spain, and the courts of the operator's registered seat have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence. (Operator legal entity, registered address and tax ID to be inserted before launch.)
